Florida Traffic Fatalities on the Increase

Posted on June 24, 2020

The Florida Highway Patrol reported 400,788 vehicle crashes in 2019, resulting in 3217 deaths and 254,342 injuries. [1] According to the Florida Crash Dashboard by the Florida Highway Safety and Motor Vehicles (FLHSMV), there were 403,626 vehicle crashes in 2018, resulting in 3135 fatalities and 255,353 injuries.  While we are seeing a positive decline in overall vehicle crashes between 2018 and 2019, we have seen a disturbing 2.6% increase in the number of traffic fatalities.

Wrongful Death

A wrongful death claim can be filed when a person is killed due to the negligence of another person.  Wrongful death claims may involve lawsuits ranging from vehicle accidents to medical malpractice to product liability.

In vehicle accidents, negligence can exist when a driver does not operate his or her car in a safe manner, resulting in a crash.  This driver, like every other driver using public roads, has the duty to drive responsibly on the road.  If the driver fails to drive safely and causes a crash, he or she can be liable for the accident, even though he or she was not involved in criminal activity nor had any intention of causing a crash.  In Florida, these types of cases can be filed by a representative of or the survivors of the person who was killed.

Compensation may be sought for mental pain and anguish from the accident, medical expenses, funeral expenses, loss of future earnings, and present and future financial losses.  Like other types of lawsuits, wrongful death claims for traffic fatalities must be initiated within specific timeframes.  If you believe you may have a case and would like to consult directly with a trusted South Florida attorney, call E Canter Lawyers at 561-447-4500.
