A Holiday Gift Gone Wrong… Common Injuries Caused by Toys

Posted on December 15, 2025

Playing with toys should be fun, not scary. Yet, in 2023, emergency departments across the nation treated 231,700 people for injuries caused by toys, according to the latest data from U.S. Consumer Product Safety Commission[1].  72% of those injured were age 14 and younger. Some of the most common injuries that toys caused include lacerations, fractures, internal injuries, strains and sprains, contusions and abrasions, foreign bodies, and ingestion[2]. Other injuries that are less common, but severe, include traumatic brain injuries, choking, burns, or poisoning. Any of these injuries could cause a long-term impact to your child’s ability to maintain a typical childhood, attend school, and have a fulfilling career when they are older.

If your child was seriously injured by a toy in South Florida, you are entitled to compensation for their injuries. Injuries caused by toys fall under a type of law called product liability. There are three types of product liability claims that your attorney could make:

  • Defective Design: in this situation, your attorney will argue that there was an inherent flaw in how the product was engineered that caused your injury.
  • Manufacturing Defect: this means that something went wrong in the manufacturing process that caused the toy to become dangerous.
  • Marketing Defect: this occurs when the product packaging omits a crucial warning for toy users, for example, if the packaging omitted a warning that there could be a choking hazard or that safety gear is needed to use the toy.

If your child was injured by a toy, seek medical attention immediately and attend all follow-up appointments. This is an essential step, both for their own health and if you decide to make a legal claim. Take photos of any visible injuries, explosions, or other damage that the toy caused. It’s also important to save the toy itself, and its packaging (if you still have it). This will be a key piece of evidence if you decide to file a claim for compensation.

You may be entitled to compensation for hospital bills, doctor bills, physical therapy, medication, lost wages, future lost wages, medical assistive devices, special schooling if your child will no longer be able to attend a typical school, psychological counseling, as well as pain and suffering.
