This past December, three people were killed when an SUV hit a bear in the Everglades on the Big Cypress Seminole Reservation. A chain reaction resulted in two other cars hit. According to CBS News and the South Florida Sun-Sentinel, of the 13 passengers in the 3 cars, two walked away uninjured. The SUV was totaled.
This brings up a number of questions that South Floridians should be aware of.
Jurisdiction Matters when Something Hits your Car
When you go for a ride and enter Indian reservation lands, what changes with regards to the laws and your rights? How does hitting an animal affect your insurance and rights? How are the different parties involved in the car accident affected?
There is the driver of the car who makes the impact, his/her passengers and of course other cars which, in the accident above, were only involved after the first SUV hit the bear.
What Are Your Rights when an Animal Hits your Car?
Check your policy! Crashes into animals, including bear, deer, and even the occasional alligator may not be covered under the collision portion of your policy. They may actually be covered under the comprehensive portion of your policy which covers damage to your vehicle for things like storms, fire, other acts of God, as well as theft or vandalism. Check your deductible on your policy, as the amount of damage caused by the animal will help you make the decision as to whether to file the claim or not.
