Help! I Tripped and Fell in the Mall Parking Lot. How Will I Pay My Medical Bills?

Posted on July 7, 2025

You had planned a fun afternoon meeting some friends at your favorite Boca Raton mall for lunch, followed by shopping for new outfits for your upcoming cruise. As you crossed the parking lot, you tripped in a pothole, spraining your ankle, and causing your head to hit the concrete floor. The next thing you knew, you were surrounded by strangers peering down on you and the sounds of a siren approaching.

While many trip and fall injuries result in nothing more than a bruised ego, others cause severe, long-term injuries and health problems. These can include a concussion, broken bones, back injuries, sprains, or strains. If you are the victim of a trip and fall accident in a Palm Beach County parking lot, you are not alone. Parking lots can contain many hazards that can increase the risk of tripping, such as:

  • Wheel stops: the concrete bars at the end of each parking spot to stop the car from driving too far forward can be a tripping hazard
  • Speed bumps: these are effective tools for preventing speeding, but they are also tripping hazards, especially if they are not brightly painted so pedestrians can avoid them
  • Poorly maintained floors that contain potholes, debris, poor drainage, or cracks
  • Lack of pedestrian walkways and unclear signage
  • Inadequate lighting, which can exacerbate any of the aforementioned other risks

To win compensation for your injuries, you will need to prove:

  • A hazardous condition existed in the parking lot.
  • The hazard was there long enough that the mall management either knew about it or should have known about it. For example, a large pothole takes a while to form, so the mall management should be aware of it. In contrast, if a lightbulb burnt out a few minutes before you tripped, they would likely not be aware of that.
  • The hazard was directly responsible for your injuries. Specifically, you will need to show that the hazard was at least 51% responsible for your injuries to win compensation.

To build the strongest possible case, it’s essential to seek medical care immediately after the accident. This medical record will form the foundation of your injury claim and lawsuit, if you decide to file one. This provides the documentation that your injury was directly caused by the trip and fall incident. You also should report your injury to the mall management right away, so they are aware that you were injured.

Contact ECanter Lawyers, one of South Florida’s preeminent personal injury law firms, as soon as you are able after your accident. We will investigate the scene of the incident and request security camera footage. The mall’s insurance company may offer you a quick settlement; however, it is likely to be a lowball offer. We have the knowledge and experience to argue for you to receive the full compensation that you deserve for your injuries. You can contact us seven days a week to schedule an appointment for a free initial consultation.
