Did Medical Malpractice Cause My Injury?

Posted on November 14, 2022

Have you ever wondered if an injury or condition that you or a loved one sustained could have been caused by negligent medical care? In most cases, if a patient has a poor outcome to a medical situation, the healthcare professionals made the right choices, but the treatment did not work as expected. However, there are times when a medical professional’s treatment choices deviate from the level of care that they should provide. This is medical malpractice.

Any healthcare professional can engage in medical malpractice – doctors, nurses, dentists, lab workers, aides, pharmacists, therapists, etc. Some of the more common examples of medical malpractice include:

  • Improper or negligent administration of anesthesia
  • Emergency room errors
  • Medical equipment failure
  • Giving the wrong medication or wrong dose of medication to treat a condition
  • Misdiagnosis of a condition, failing to diagnose a condition, or diagnosing it too late
  • Surgical errors, such as operating on the wrong body part or leaving something inside the body that should not be there

According to Florida law, to prove that you are the victim of medical malpractice, you will need to show that:

  • The healthcare professional had a duty of care toward the patient.
  • “The alleged actions of the health care provider represented a breach of the prevailing professional standard of care for that health care provider. The prevailing professional standard of care for a given health care provider shall be that level of care, skill, and treatment which, in light of all relevant surrounding circumstances, is recognized as acceptable and appropriate by reasonably prudent similar health care providers.”[1]
  • You suffered harm as a result of the breach of care.

The statute of limitations for filing a medical malpractice suit in Florida is two years since the discovery of the malpractice or 4 years since it occurred. You are eligible to collect damages for doctor bills, hospital bills, medication, medical supplies, rehabilitation, nursing care, lost wages, future lost wages, pain and suffering, mental anguish, and loss of consortium.

Medical malpractice cases can take a long time to resolve and are difficult to prove, so you will want an attorney who specializes in this, like ECanter Lawyers, on your side. Your attorney will obtain all your medical records and work with medical experts, who will review the records to determine if your healthcare provider was negligent in your care.
