What Are My Rights After a Slip and Fall Accident?

Posted on March 21, 2022

Slipping and falling in a store can be embarrassing. But more importantly, it’s also dangerous, especially for older people. Three million older Americans are treated in emergency rooms each year for falls and more than 800,000 are hospitalized. In fact, falls are the most common cause of traumatic brain injuries (TBIs). In addition to TBIs, falls can also cause sprains, broken bones, and lead to a persistent fear of falling, causing sufferers to curtail daily activities. Any of these conditions can lead to lost wages, high medical bills, and significant amounts of emotional trauma. If you or a loved one has been injured due to a slip and fall in a store, you deserve compensation or your losses.[1]

According to Florida’s laws, you have up to four years to file a lawsuit for a slip and fall injury, but you would never want to wait that long. Slip and fall lawsuits are notoriously complex because it can be difficult to establish fault. To win a suit, you will need to prove that the store was aware that there was a dangerous condition on their property (or should have been aware of it), they did not take steps to fix the condition, and this condition led to your injuries. For example, let’s say you are walking down the aisle in the grocery store and there is a puddle of water on the ground from a leaky roof and you slip and fall because of it. In this instance, the store could be held liable because they should have been aware that their roof was leaking and should have put up a warning sign. In contrast, let’s assume you are walking down the aisle at the supermarket and the person in front of you spills something and you slip on it. The store could not know that the spill just happened, so it may not be liable in this situation. Because of complexities such as these, it’s essential that you work with an experienced slip and fall attorney, like ECanter Lawyers.

To maximize your chances of winning a slip and fall lawsuit, following are some steps to take after a fall:

  • File an incident report with the store manager. Be truthful and accurate in describing the situation.
  • Seek medical care right away and follow all the doctor’s orders.
  • Preserve any evidence, such as torn or bloodied clothing or glasses or any damaged personal items.
  • If possible, take photos and videos of the condition that caused you to slip, such as a puddle on the floor, debris in the aisle, uneven sidewalks in front of the store, etc.

Contact ECanter Lawyers as soon as you can after your fall. We will listen to your situation and conduct additional investigations if necessary. Based on our findings, we will advise on the best course of action to compensate you for your losses.
