Valentine’s Getaway Gone Wrong: What to Do if You are Injured at a Hotel

Posted on February 9, 2024

The romantic getaway you planned turned into a medical nightmare. You spent so much time in the hospital that you didn’t even have the opportunity to enjoy the amenities at the resort where you were staying. If you were injured at a hotel, we can’t help you rekindle the lost romantic weekend, but we can help you secure compensation for your injuries. The steps you take after you are injured can have a major impact whether you are able to sue the hotel for damages and your likelihood of winning a lawsuit.

Some of the types of injuries that hotel guests experience include:

  • Tripping over objects or torn carpets in the lobby, conference room, or guest room
  • Tripping due to an uneven surface
  • Slipping on a spilled drink on a slick floor or the pool deck
  • Slipping or tripping on the stairs
  • Drowning or near-drowning in the pool
  • Elevator or escalator malfunctions

If you are injured at a hotel, following are some steps you can take that will help build your case if you decide to file a lawsuit against the hotel:

  • Visit a local urgent care center or emergency room to seek medical attention right away. The sooner you see the doctor, the sooner you can start your healing process. Similarly, the longer you wait to seek medical attention, the easier it will be for the opposing side to claim your injury was either not serious or caused by something other than their facility.
  • Report the injury to hotel management right away so they can log it with their insurance company.
  • Take photos of the condition that led to your injury, such as torn carpet, lack of adequate handrails, video of the elevator malfunctioning, etc. This is very important because once you notify the hotel of your injury, they may quickly fix the condition, leaving you with no evidence that the condition existed. Additionally, request a copy of the surveillance footage showing the accident that led to your injury. Footage may be erased regularly, so request it as soon as you can to avoid this happening.
  • Call a Florida-based personal injury attorney to learn about your legal rights. If the accident that caused your injury occurred at a hotel in Florida, your attorney needs to be licensed to practice in Florida, regardless of whether you are a Florida resident or not.

You may be entitled to compensation to cover your medical bills, medication, physical therapy, medical supplies, psychological counseling, lost wages, future lost wages, as well as pain and suffering. Contact ECanter Lawyers for a free consultation on your case. We can advise you if you have a legal case against the hotel, and, if so, your options for securing compensation for your injuries.
