You’re sitting on I95, stuck in a traffic jam as usual. While the driving lanes are at a complete standstill, the express lanes are clear. It’s so tempting to enter the express lane and then jump back over in a couple miles – just to make some progress. You’ve seen other people doing it and it seems to work for them. Should you try it? Just this once? Absolutely not – don’t even think about it!
The process of entering an express lane for a brief period of time and then jumping back into the regular driving lanes is called “lane diving” and has been implicated as the cause of some gruesome highway accidents.
Express lanes are designed for traveling long distances at high rates of speed. Drivers in these lanes are not expecting a slow-moving vehicle. If someone is driving a car in the regular lanes and wants to switch into the express lanes, their car will be entering the lane from a complete stop or, minimally, a very slow speed. It can take several seconds for the entering car to reach the full highway speed of 65-70 miles per hour. If a car is already traveling in an express lane at 65+ miles per hour and sees a slow-moving car enter the lane, they may not have enough time to slow down to avoid hitting the entering car. Additionally, the car already in the express lane may slam on the brakes so hard that they lose control of the car and flip over or crash. If there is inclement weather, the car already in the express lane could skid into another lane, car, or object when they slam on the brakes to stop the car.
Since these types of accidents are happening at such high speeds, it greatly increases the chance of a fatality or serious, life-changing injury, such as a traumatic brain injury or spinal cord injury.
If you have been seriously injured in a lane diving accident, you have the right to compensation for your injuries. This includes funds for medication, hospitalizations, doctors’ bills, MRIs, X-rays, physical therapy, nursing care, lost wages, and future lost wages. You are also entitled to collect compensation for your noneconomic losses, such as pain and suffering and loss of consortium. If your loved one experienced a wrongful death due to a lane diving crash, you also may be entitled to funds to cover the cost of their funeral and burial.
