Amusement Park Injuries

Posted on December 18, 2023

Florida is the world’s unofficial amusement park capital. From the world-class parks in Orlando to local parks and carnival rides here in South Florida, nobody does amusement park rides like we do. The overwhelming majority of parkgoers experience the thrills of the roller coasters, take a spin on the carousel, eat sugar-topped funnel cakes, and create lifelong memories. Unfortunately, though, not everyone has this idyllic outcome. Every year, more than 34,000 individuals are injured at amusement parks throughout the country[1]. 44% of these are children between the ages of five and 14 and 21% are adults aged 25-64[2].

While many of the injuries are minor cuts and scrapes, some can be more serious. These include concussions, broken bones, internal organ injuries, or lacerations. These types of injuries can often take months or years to heal, causing pain and financial worries in the interim.

If you have been injured in an amusement park in Florida, you will need a Florida-based personal injury attorney to represent you if you decide to file a lawsuit to recover compensation for your injuries. Your attorney will conduct an investigation to determine the cause of the accident. There are typically three reasons why injuries occur in amusement parks:

  • Mechanical failure: this is when the ride itself malfunctions, such as a safety belt or bar releasing while the ride is in motion, a ride derailing, or becoming stuck upside down, etc. The cause could be the park’s lack of proper maintenance or inspections. In this situation, your attorney would sue the park for negligence. Another possibility is that there was a production error with the ride itself, such as a faulty design or manufacturing error. In this latter case, your attorney would file suit against both the park and the ride manufacturer.
  • Operator Failure: this is when a park employee makes a mistake that leads to your injury. This could include failing to check that the seatbelt was properly fastened, or failing to check that the rider met the size requirements. In this situation, your attorney would sue the park for negligence.
  • Rider Behavior: this is when a rider does not comply with the park’s posted safety requirements, such as sticking their hands out side of the ride, standing up during a ride, etc. In this situation, your attorney likely will advise you that you are unable to secure compensation from the park for your injuries.
